1. General
These Terms of Service govern the use of the Fernando Barata Editions website and all purchases made through this online store.
By accessing this website or placing an order, you agree to be bound by these Terms of Service.

2. Products
Fernando Barata Editions offers museum-quality Fine Art Prints and Collector Editions created by artist Fernando Barata.
Open Prints are produced exclusively to order according to the customer's selected size.
Collector Editions are hand-signed, accompanied by a certificate of authenticity and produced in strictly limited quantities.
Product images are provided for illustrative purposes. Slight variations in colour, texture or appearance may occur due to screen settings and the printing process.

3. Pricing and Payment
All prices are displayed in the currency selected by the customer.
Applicable taxes are calculated during checkout where required.
Payments are securely processed through Shopify Payments, Shop Pay, PayPal and any other payment methods made available at checkout.
Fernando Barata Editions does not store customers' payment information.

4. Shipping
Orders are produced after payment has been successfully received.
Estimated production and delivery times are provided for information only and may vary depending on destination, customs procedures and carrier operations.
Customers are responsible for any customs duties, import taxes or local fees applicable in their country.

5. Returns and Refunds
Open Prints are produced exclusively to order and are not eligible for the statutory right of withdrawal where an exception for custom-made goods applies under applicable law.
Collector Editions are unique, hand-signed artworks accompanied by a certificate of authenticity. All sales of Collector Editions are final.
If an artwork arrives damaged or defective, customers should contact Fernando Barata Editions within seven (7) days of delivery with photographs of the artwork, packaging and their order number.
Nothing in these Terms limits the customer's statutory rights under applicable consumer protection laws.

6. Intellectual Property
All artworks, photographs, texts, logos, designs and other content displayed on this website are protected by copyright and intellectual property laws.
No artwork or content may be reproduced, copied, distributed, modified or used for commercial purposes without the prior written permission of Fernando Barata Editions.
The purchase of an artwork transfers ownership of the physical print only. No intellectual property rights or reproduction rights are transferred to the purchaser.

7. Limitation of Liability
Fernando Barata Editions shall not be liable for delays or failures resulting from events beyond its reasonable control, including but not limited to natural disasters, strikes, customs delays, transportation disruptions or other force majeure events.
To the fullest extent permitted by applicable law, liability is limited to the amount paid for the relevant order.

8. Governing Law
These Terms of Service shall be governed by and interpreted in accordance with the laws of France.
Nothing in these Terms deprives consumers of the mandatory protections granted by the laws of their country of residence where applicable.
